Terms of use

These terms apply to the Wombat Words app and this website. The app is provided by Fiume Systems Pty Ltd ("we", "us"). By downloading or using the app, you agree to these terms. If you don't agree, please don't use the app.

1. Who can use Wombat Words

An adult should download and set up the app. You can add children if you are their parent or legal guardian, or have their parent's permission. You're responsible for how children use the app on your device, and for keeping your device secure, for example with a passcode.

2. Your licence

We give you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, for your family's non-commercial use, as allowed by the Apple Media Services Terms and Conditions. You may not copy, resell, reverse engineer or redistribute the app or its content, or use it to run a commercial tutoring service, without our written permission.

3. Price and purchases

Wombat Words is free to download. The free version includes Set 1 stories, handwriting practice, stickers and the last 14 days of progress for one child. Wombat Words Plus is an optional auto-renewing subscription that unlocks every story set, the full progress report, more children and printables. It is offered yearly (with a 14-day free trial for new subscribers) or monthly, at the prices shown in the app and on the App Store.

Purchases are made through the Apple App Store, billed to your Apple Account, and are only available in the grown-ups' area of the app. If you start a free trial, you are charged when the trial ends unless you cancel before then. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the end of the period. You can manage or cancel your subscription in Settings › Apple Account › Subscriptions; cancelling stops the next renewal, and Plus stays active until the end of the period you've paid for. With Family Sharing turned on, members of your Family Sharing group can use the subscription. Refund requests are handled by Apple under its policies. Nothing in these terms limits your rights under the Australian Consumer Law.

4. Educational purpose

Wombat Words is designed to support reading and handwriting practice at home. Scores, words-correct-per-minute figures, year-level guides and phonics statuses are indicators to help you follow progress. They are not a diagnosis or a formal assessment. If you have concerns about your child's reading, writing or development, please talk to their teacher or a qualified professional.

5. Stories

The stories in the app are written in advance to match each phonics level. Some were drafted with the help of AI writing tools, and every story is checked against reading-level and content rules before it is added. We work hard to keep every story age-appropriate. If you ever see something that isn't suitable, please email us and we'll fix it in the next update.

6. Reading and handwriting results

Reading results are based on the words a grown-up marks as missed while the child reads aloud. Handwriting scores compare your child's tracing with the letter shapes of the handwriting style you chose. They are helpful guides but aren't perfect, especially for very young writers, and a low score on one word isn't cause for concern.

7. Your data on your device

The app saves your family's information only on your device; we don't receive or store it. That means you are in control of it, but also that we can't recover it for you. If you delete the app or lose your device without a backup, your child's history can't be restored. Device backups, such as iCloud Backup, include the app's data.

8. Content and intellectual property

The app, its stories, the Wombat Words name and logo, and the character Digby are owned by us or our licensors and protected by copyright and trade mark law. The school handwriting fonts are used under the SIL Open Font License. You may print the practice sheets, stories and certificates the app makes for personal, family and classroom use with your own child, but not for sale.

9. Fair use

Please don't misuse the app, for example by trying to extract its content with automated tools or by redistributing its stories or artwork.

10. Privacy

Our privacy policy explains how the app and this website handle your family's information, including your child's. It forms part of these terms.

11. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under law that cannot be excluded.

12. Limits on our liability

To the extent the law allows, and except for the guarantees above, we provide the app "as is". We're not liable for indirect or consequential loss, including loss of data stored on your device, and our total liability to you is limited to resupplying the service or the amount you paid us in the 12 months before the claim, whichever we choose. This doesn't limit liability that can't be limited by law.

13. Changes to the app

We keep improving Wombat Words, so features may change in updates. If we stop offering the app, we'll give reasonable notice where we can. The app keeps working offline with the information already on your device.

14. Stopping use

You can stop using Wombat Words at any time. Remove a child in the app's Setup screen, or delete the app to remove all its data from your device. If you have a subscription, deleting the app doesn't cancel it; cancel it in your Apple Account settings.

15. Changes to these terms

We may update these terms. If a change is significant, we'll tell you in the app before it takes effect. If you keep using the app after that, the new terms apply.

16. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the extent the law allows, Apple has no other warranty obligation. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.

17. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the courts of New South Wales, without limiting any right you have to bring a claim where you live under consumer law.
